Please read these Terms of Service carefully before accessing or using the GoEducated.com platform. By registering, enrolling in a course, or using any feature of this platform, you agree to be legally bound by these Terms. If you do not agree, please discontinue use immediately.

1. Definitions

In these Terms of Service, the following terms have the meanings set out below:

• "Platform" means the GoEducated.com website, all sub-domains, mobile applications, LMS portals, and any related digital services operated by SPPS Fly High Edutech Pvt. Ltd.
• "Company" means SPPS Fly High Edutech Pvt. Ltd., a company incorporated under the Companies Act 2013, with its registered office at The Nook, #8/1, 3rd Floor, Venkatrama Layout, Jaibharath Nagar, Maruthi Sevanagar Post, Bangalore North, Karnataka, India, 560033.
  Corporate Office & Institute Address: WeWork, Global Tech Park #37, Cunningham Road, Vasanth Nagar, Bengaluru – 560001, Karnataka, India.
• "User" / "You" means any person who accesses, browses, registers on, or transacts through the Platform, including students, prospective learners, working professionals, corporate clients, and institutional partners.
• "Partner Institution" means any university, college, coaching centre, or certification body whose programmes are listed or delivered through the Platform, including but not limited to Boston Institute of Analytics (BIA) and AICerts.
• "Course" means any educational programme, certification, diploma, degree programme, coaching module, counselling session, or study-abroad service listed on the Platform.
• "Content" means all text, images, video, audio, assessments, study materials, live classes, recorded lectures, and other educational materials made available through the Platform.
• "Enrolment" means the confirmation of your registration in a Course after successful payment of applicable fees.

2. Nature of the Platform

GoEducated.com operates as an education aggregator and intermediary platform. The Company:

• Lists, promotes, and facilitates enrolment in Courses offered by Partner Institutions.
• Provides its own foundation, competitive coaching, and counselling services directly to learners.
• Acts as a technology intermediary under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021 in respect of third-party content and Partner Institution programmes.

For Courses delivered directly by GoEducated (foundation coaching, counselling, in-person offline classes at our Bengaluru centre), the Company is the sole service provider. For Courses offered by Partner Institutions, GoEducated facilitates enrolment, and the Partner Institution bears primary responsibility for content delivery, assessments, and certification.

3. User Eligibility and Account Registration

3.1 Eligibility

• You must be at least 13 years of age to use the Platform.
• Users between 13 and 18 years must have prior parental or guardian consent.
• By using the Platform, you represent and warrant that all information you provide is accurate, current, and complete.

3.2 Account Creation

• You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials.
• You agree to notify us immediately at reachus@goeducated.com if you suspect any unauthorised access to your account.
• The Company reserves the right to suspend or terminate accounts found to contain false or misleading information.

3.3 One Account per User

• Each individual may maintain only one active account. Creation of multiple accounts by the same individual is prohibited and may result in termination of all associated accounts without refund.

4. Enrolment and Fees

4.1 Enrolment Process

• Enrolment is confirmed only upon receipt of full payment (or the first instalment in an EMI arrangement) and issuance of a Confirmation of Enrolment by the Company.
• Course availability, eligibility criteria, and batch schedules are displayed on the Platform and are subject to change without prior notice.

4.2 Pricing

• All prices displayed on the Platform are in Indian Rupees (INR) and are inclusive of applicable taxes (GST) unless explicitly stated otherwise.
• Prices are subject to change at any time without notice. Changes will not affect confirmed enrolments.

4.3 Payment

• Payments are processed through Razorpay or such other PCI-DSS-compliant payment gateways as the Company may designate from time to time.
• Accepted payment modes include: UPI, Net Banking, Debit/Credit Cards, Wallets, and EMI (subject to eligibility).
• The Company does not store full payment card details on its servers.

4.4 GST and Invoicing

• GoEducated is registered under the Goods and Services Tax Act. A GST-compliant invoice will be issued for every successful transaction.
• Corporate clients seeking invoices with their GSTIN must provide accurate GSTIN details at the time of enrolment.

5. User Obligations and Prohibited Conduct

5.1 Permitted Use

You agree to use the Platform solely for lawful purposes and in accordance with these Terms. You may access Course Content for your personal, non-commercial educational use.

5.2 Prohibited Conduct

You must not:

• Share your account login credentials with any other person or allow third parties to access your enrolled courses.
• Download, copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any Course Content without prior written permission from the Company or the relevant Partner Institution.
• Record, screen-capture, or screen-record live or pre-recorded sessions without explicit written authorisation.
• Upload, post, or transmit any content that is unlawful, harmful, abusive, defamatory, obscene, or otherwise objectionable.
• Engage in academic dishonesty, including plagiarism, impersonation, or cheating in assessments.
• Use any automated tools, bots, scrapers, or crawlers to access or collect data from the Platform.
• Attempt to probe, scan, or test the vulnerability of the Platform or breach any security or authentication measures.
• Misrepresent your identity, qualifications, or affiliation.
• Engage in any conduct that could damage the reputation or business of the Company or any Partner Institution.

5.3 Consequences of Breach

Violation of these obligations may result in immediate suspension or termination of your account, forfeiture of Course fees without refund, and/or legal action under applicable Indian law.

6. Intellectual Property Rights

All Content on the Platform, including but not limited to course materials, videos, assessments, branding, logos, trademarks, software, and databases, is the exclusive property of SPPS Fly High Edutech Pvt. Ltd. or its Partner Institutions and is protected by Indian and international intellectual property laws, including the Copyright Act 1957 and the Trade Marks Act 1999.

• GoEducated grants you a limited, non-exclusive, non-transferable, revocable licence to access and use Course Content solely for your personal educational purposes during your active enrolment period.
• This licence does not include the right to sub-license, sell, resell, transfer, assign, or commercially exploit any Content.
• All goodwill generated through the use of the GoEducated or BIA brand remains exclusively with the Company or the respective Partner Institution.

Any unauthorised use, reproduction, or distribution of Course Content may constitute copyright infringement and may result in civil and criminal liability under the Copyright Act 1957.

7. Platform Availability and Technical Issues

• The Company endeavours to maintain the Platform’s availability 24 hours a day, 7 days a week, but does not guarantee uninterrupted access.
• Scheduled maintenance, system upgrades, or events beyond our control (force majeure) may result in temporary downtime. We will provide advance notice where practicable.
• The Company is not liable for any loss or inconvenience arising from temporary unavailability of the Platform or technical failures.
• Users are responsible for ensuring they have adequate internet connectivity, compatible devices, and updated browsers to access the Platform.

8. Partner Institution Terms

Courses offered by Partner Institutions (BIA, AICerts, partner universities) are subject to the additional terms and conditions of those institutions. By enrolling in such a Course, you agree to abide by the Partner Institution’s:

• Academic policies, including attendance requirements, assessment policies, and code of conduct.
• Certification criteria and grading standards.
• Placement assistance policies (where applicable).

In the event of any conflict between these Terms and the Partner Institution’s terms regarding Content delivery and certification, the Partner Institution’s terms shall prevail for that specific matter.

9. Disclaimers and Limitation of Liability

9.1 No Guarantee of Outcomes

GoEducated does not guarantee specific academic results, career outcomes, job placements, salary increments, or admission to any institution as a result of using the Platform or completing any Course. Course outcomes depend on individual effort, aptitude, and market conditions.

9.2 Third-Party Content

As an education aggregator, the Company is not responsible for the accuracy, completeness, or fitness for purpose of Content provided by Partner Institutions. Any reliance on such Content is at your own risk.

9.3 Limitation of Liability

To the maximum extent permitted by applicable law, the Company’s aggregate liability to you for any cause of action arising out of or in connection with these Terms shall not exceed the total fees paid by you for the specific Course giving rise to the claim in the twelve (12) months preceding the date of the claim.

The Company shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunity, even if advised of the possibility of such damages.

9.4 Consumer Protection Act 2019

Nothing in these Terms limits or excludes any rights you may have under the Consumer Protection Act 2019 that cannot be waived or excluded by agreement. Where the Consumer Protection (E-Commerce) Rules 2020 impose specific obligations on the Company, those obligations are complied with and shall prevail over any conflicting provision in these Terms.

10. Study Abroad Services

GoEducated offers end-to-end study-abroad guidance as a facilitation service. Users acknowledge that:

• The Company does not guarantee admission to any foreign university and acts solely as a facilitator and guide.
• Visa approvals, student visa decisions, and immigration clearances are the exclusive domain of the relevant foreign government authority.
• Application fees and service charges paid for study-abroad facilitation are non-refundable once the application process has commenced, unless otherwise specified in the applicable Refund Policy.
• The Company is not responsible for changes in foreign universities’ admission criteria, tuition fees, or visa regulations.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to conflict of law principles.

11.2 Jurisdiction

Subject to the arbitration clause below, the courts of Bengaluru, Karnataka, shall have exclusive jurisdiction to adjudicate any dispute arising out of or in connection with these Terms.

11.3 Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act 1996 (as amended). The seat and venue of arbitration shall be Bengaluru, Karnataka. The arbitration shall be conducted in English by a sole arbitrator mutually agreed upon by the parties, or, failing agreement, appointed in accordance with the said Act.

11.4 Consumer Forum

Notwithstanding the arbitration clause, individual consumer users retain the right to approach the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act 2019.

12. Termination

The Company reserves the right to terminate or suspend your account and access to the Platform, with or without notice, for any of the following reasons:

• Breach of these Terms.
• Suspected fraudulent activity.
• Failure to pay applicable fees.
• Any conduct that the Company deems harmful to the Platform, other users, or Partner Institutions.

Upon termination, your licence to access Course Content will cease immediately. The Company will retain your data as required by law and in accordance with our Privacy Policy.

13. Modifications to Terms

The Company reserves the right to modify these Terms at any time. Changes will be posted on the Platform with a revised effective date. Your continued use of the Platform after any modification constitutes your acceptance of the revised Terms. For material changes, we will provide at least 15 days’ advance notice via email.
